The Committee considered 15/01194/F for a change of use from agricultural land to cemetery land at Land adjacent Hardwick Hill Cemetery, Southam Rd., Banbury for Banbury Town Council.
Kate Fitton, local resident, addressed the committee in objection to the application.
In reaching their decision, the Committee considered the officers’ report, presentation, written update and the address of the public speaker.
Resolved
That application 15/01194/F be approved, subject to the following conditions:
1. The development to which this permission relates shall be begun not later than the expiration of three years beginning with the date of this permission.
2. Except whereotherwise stipulated by condition, the development shall be carried out strictlyin accordancewith thefollowingplans anddocuments: Application forms,Site LocationPlan and Design and Access Statement.
3. Prior to the commencementofdevelopment herebyapproved, aphasing plancovering the entire siteshallbe submittedtoand approvedinwriting bythe LocalPlanningAuthority. Thereaftereachreservedmattersapplicationshallrefertoa phase, phases, or part thereof identified in the phasing plan.
4. Prior to the commencementofthedevelopment herebyapproved, alandscaping scheme shall besubmittedtoand approvedin writingbytheLocalPlanningAuthority. Thescheme for landscaping the site shall include:-
(a) detailsofthe proposedtree andshrub plantingincluding theirspecies,number, sizes and positions, together with grass seeded/turfed areas,
(b) detailsofthe existingtreesandhedgerowstoberetainedaswellasthosetobe felled, including existingand proposedsoillevels atthebase ofeach tree/hedgerowand the minimum distance between the base of the tree and the nearest edge of any excavation,
(c)details of the hardsurfaceareas, includingpavements, pedestrianareas,reduced-dig areas, crossing points and steps.
5. All planting, seedingor turfingcomprisedin theapproved detailsoflandscapingshallbe carried outin accordancewith BS4428:1989 CodeofPractice forgeneral landscape operations (excluding hard surfaces), or the most up to date and current British Standard, in thefirstplanting andseedingseasons followingthe occupationofthebuilding(s)or onthe completionofthe development,whicheveristhesooner. Anytrees, herbaceousplanting and shrubs which, withina periodof fiveyears fromthe completionof thedevelopment die, are removed or become seriously damaged or diseased shall be replaced in the current/next planting season with others of similar size and species.
6. Prior to the commencementofthedevelopmentandnotwithstandingthesubmitted details, an arboriculturalsurvey, undertakenin accordancewith BS:5837:2012and allsubsequent amendmentsand revisionsshallbe submittedtoand approvedin writing by theLocal Planning Authority.
7. Priorto the commencement of the development hereby approved, an Arboricultural Method Statement (AMS), undertaken in accordance with BS:5837:2012 and all subsequent amendmentsand revisions shallbe submittedtoand approvedin writing by theLocal PlanningAuthority.Thereafter,all works onsiteshallbe carriedout inaccordance withthe approved AMS.
8. Thedevelopmenthereby approvedshallbe carriedout strictlyin accordance with the recommendations andspecifications setout inthe ArboriculturalMethod Statement(AMS).
9. Theexisting hedgerowsalongall boundariesofthesiteshallberetained and properly maintainedata heightofnotlessthan3 metres, andifanyhedgerowplantdies withinfive years fromthe completionofthe developmentit shallbereplaced andshall thereafterbe properly maintained in accordance with this condition.
10. Notwithstandingthe illustrativedetailsshown inthe Designand accessstatement priorto the commencement of the development hereby approved, full specification details (including siting, construction, layout, surfacing anddrainage) of theturning area and additional parkingspaceswithin thecurtilage ofthe site,arrangedsothat motorvehicles mayenter, turnroundand leavein aforward directionand vehicles may parkoffthe highway, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development.
11. Prior to the commencement of the development hereby approved a professional archaeologicalorganisation acceptabletotheLocal PlanningAuthority shall preparean Archaeological WrittenScheme ofInvestigation, relatingtothe applicationsitearea,which shall be submitted to and approved in writing by the Local Planning Authority.
12. Prior the commencementofthedevelopment herebyapproved, andfollowingthe approval of theWrittenSchemeofInvestigation referredtoin condition11,a stagedprogramme of archaeological evaluation and mitigation shall be carried out by the commissioned archaeological organisation in accordance with the approved Written Scheme of Investigation.
13. Prior to the commencementofthe developmenthereby approved,includingany demolition and any works of site clearance, a Phase 1 Survey of the site and any additional recommendedspeciesandhabitat surveysshallbecarried outonsite,anda reportofthe findings along with all necessary mitigation, working method statements, licence applications andnecessary offsitecompensationmeasures, shall besubmittedtoand approvedin writingbythe LocalPlanning Authority.Thereafter, thedevelopment shallbe carried out in strict accordance with the approved details.
14. Prior to, and within two months of, the commencement of the development, the site shall be thoroughlychecked bya suitablyqualified ecologisttoensurethat noprotected species, which couldbe harmedbythedevelopment, havemovedon tothesitesince theprevious surveyswere carriedout. Shouldany protectedspeciesbe foundduring this check,full details ofany additionalmitigation measurestoprevent theirharm shallbe submittedto andapproved inwriting bythe LocalPlanningAuthority. Thereafterthe developmentshall becarried out in accordance with the approved mitigation scheme.
15. No removal ofhedgerows, treesor shrubs,shalltake placebetweenthe 1stMarchand 31stAugustinclusive,unless theLocal PlanningAuthority hasconfirmedin writingthat suchworks canproceed,based onhealth andsafetyreasons inthecase ofa dangerous tree,or thesubmissionofa recentsurvey (noolderthanone month)that hasbeen undertaken bya competentecologist toassess thenesting birdactivity onsite, together with details ofmeasures to protect the nesting bird interest on the site.
16. Prior to the commencement of the development hereby approved, a Landscape and Ecology ManagementPlan (LEMP)shall besubmitted toand approvedin writingbythe LocalPlanning Authority.Thereafter,the LEMPshall becarriedoutinaccordancewiththe approved details.
17. All speciesusedin theplanting proposalsassociated withthe developmentshallbenative species of UK provenance.
18. Prior to the commencement of the development hereby approved, including any demolition, andany worksofsiteclearance,a methodstatementforenhancing biodiversityonsite shallbe submittedtoand approvedin writingbytheLocal PlanningAuthority. Thereafter, thebiodiversity enhancementmeasuresshall becarried outand retainedin accordance with the approved details.
19. Priortothecommencementofdevelopmenta landdrainageand groundwater surveyshall beundertaken, fromwhichshallbeproduceda landuseandgroundwaterstrategywhich shall be submitted and approved by the Local Planning Authority , and which shall thereafter be complied with in the implementationof the use of the land
